Mises en cause

Me Migen DIBRA, pleaded successfully in front of the Quebec Labour relations board, an independent tribunal specialised in labour relations, in a matter regarding a Union's duty of fair representation pursuant to article 47.2 of the Labour Code. The C.R.T. found that the SYNDICAT DES COLS BLEUS REGROUPÉS DE MONTRÉAL (SCFP, 3001), had breached its duty of fair representation by acting in an arbitrary and seriously negligent manner in respect to Mr Rudolph Adler and Mr Stephen Huets' grievances

NOTE:It is appropriate to mention that according to the author Fernand Morin and al, over a period of five years (5), from the 25th of November 2002 until the 21st of November 2007, the C.R.T. has received 2 353 complaints pursuant to article 47.2 of the Labour Code, but regardless of this very high number of complaints only 95 of them were granted by the C.R.T

Me Migen DIBRA successfully defended a Quebec Superior Court judgment and pleaded a Union's duty of fair representation, before the Quebec Court of Appeal. The application to appeal the Superior Court judgment was filed by the SYNDICAT DES COLS BLEUS REGROUPÉS DE MONTRÉAL (SCFP, 3001). The Court of Appeal upheld the Superior Court's judgment reversing a decision by the Commission des relations du travail to the effect that the petitioners' complaints against their Union were brought after the expiry of the 6 month delay provided by article 47.3 C.t

She successfully pleaded a Union's duty of fair representation matter, before the Quebec Superior Court, reversing a decision of the Commission des relations du travail.
In an application for judicial review of a ruling regarding a union duty of fair representation matter the superior court upheld the arguments of the petitioners' council and reversed a decision by the Commission des relations du travail to the effect that the petitioners' complaints against their Union were brought after the expiry of the 6 month delay provided by article 47.3 C.T. Attorney MIGEN DIBRA represented the successful petitioners.
